These Terms of Service govern purchases and use of the Texel Comp LLC Shopify storefront. By placing an order, requesting a quotation, or otherwise using this store, you agree to these Terms together with any applicable quotation, invoice, product-specific terms, Shipping Policy, Return & Refund Policy, and Privacy Policy.

1. About Texel Comp

Texel Comp LLC provides professional technology products for radiology, medical imaging, healthcare, and related technical environments.

Products offered through this store may include medical displays, workstations, computer hardware, professional graphics solutions, calibration and quality-control products, accessories, and related equipment.

2. Product Information

Texel Comp makes reasonable efforts to present accurate product information.

Specifications, compatibility, regulatory status, warranty information, included accessories, availability, lead times, pricing, and other product details may vary by exact model, manufacturer, configuration, condition, or supplier.

Where a product page, quotation, invoice, or written order confirmation contains more specific information, that specific information controls.

Customers are responsible for confirming that a product is appropriate for their intended use before purchase.

3. Medical and Regulatory Use

Some products sold by Texel Comp may be intended for professional medical or diagnostic environments.

A product’s suitability for a particular clinical, diagnostic, mammography, DICOM, quality-control, regulatory, or compliance purpose depends on the exact model, configuration, intended use, facility requirements, applicable standards, and other circumstances.

Texel Comp does not represent that purchasing equipment by itself guarantees compliance with any healthcare, accreditation, regulatory, quality-control, or professional standard.

Customers remain responsible for confirming applicable clinical, regulatory, facility, and professional requirements.

4. Orders

Submitting an order does not necessarily constitute final acceptance by Texel Comp.

Texel Comp may review an order for:

  • payment authorization;
  • pricing accuracy;
  • product availability;
  • shipping requirements;
  • configuration requirements;
  • suspected fraud;
  • compatibility concerns; or
  • other legitimate business reasons.

An order may be declined or canceled before fulfillment where reasonably necessary.

If payment has already been collected for an order that Texel Comp cancels, the applicable amount will be refunded.

5. Quotations and Special Orders

Written quotations may contain additional or different terms specific to the quoted products or project.

If there is a conflict between these general Terms and an accepted written Texel Comp quotation, the specific quotation terms will control for that transaction.

Custom-built, specially configured, special-order, project-specific, and specially quoted products may be non-returnable as stated in the applicable quotation, invoice, product page, or Return & Refund Policy.

6. Pricing

Prices may change without notice before an order is accepted.

Texel Comp may correct typographical, pricing, specification, or listing errors before fulfillment.

If a material pricing error is identified after an order is submitted, Texel Comp may contact the customer to confirm the corrected price or cancel and refund the affected order.

7. Payment

Customers must provide valid payment information and authorization.

Available payment methods are those presented during checkout or expressly agreed to by Texel Comp.

For approved returns, a payment-processing recovery deduction may apply only where permitted by applicable law and as specifically described in the Return & Refund Policy.

8. Taxes

Applicable sales tax or other transaction taxes may be collected when required.

Customers claiming tax-exempt status must provide valid and acceptable exemption documentation before tax-exempt treatment can be applied where required.

Customers are responsible for any taxes or obligations not collected by Texel Comp when legally applicable to them.

9. Shipping and Delivery

Texel Comp’s online checkout is currently configured for shipping within the 48 contiguous United States and Washington, D.C.

Customers requesting delivery to Alaska, Hawaii, U.S. territories, APO/FPO addresses, or other locations not supported through online checkout should contact Texel Comp before placing an order.

Orders may ship by parcel carrier, fulfillment partner, distributor, or freight carrier depending on the product, size, value, weight, destination, availability, and handling requirements.

Some orders may be fulfilled in multiple shipments.

Shipping charges, free-shipping offers, expedited-delivery options, delivery requirements, damage procedures, and related terms are governed by Texel Comp’s Shipping Policy and any applicable quotation or invoice.

Delivery estimates are estimates unless Texel Comp expressly confirms a guaranteed delivery commitment in writing.

10. Inspection Upon Delivery

Customers should inspect delivered products promptly.

Visible freight or shipping damage should be documented at delivery whenever possible.

Customers should retain packaging, labels, photographs, delivery documentation, and other materials that may be needed for a shipping or damage claim.

11. Returns and Refunds

Eligible returns are governed by Texel Comp’s Return & Refund Policy.

Unless otherwise stated, eligible returns must be requested within 14 calendar days of delivery.

Approved returns may be subject to:

  • a 20% restocking fee; and
  • up to a 2.99% payment-processing recovery deduction, but only to the extent that the applicable processing cost was actually incurred by Texel Comp, was not returned or credited by the payment processor, and the deduction is permitted by applicable law.

Custom-built, specially configured, special-order, and custom-quoted products may be non-returnable.

12. Product Compatibility

Customers are responsible for reviewing compatibility requirements before purchasing products intended to operate with existing systems, workstations, graphics hardware, monitors, software, operating systems, drivers, or other equipment.

Texel Comp may provide product or configuration guidance based on information supplied by the customer, but compatibility can depend on factors outside Texel Comp’s control.

No compatibility statement should be interpreted more broadly than the exact products, versions, and configuration addressed.

13. Manufacturer Warranties

Warranty coverage varies by product and manufacturer.

Only warranty information specifically stated for the exact product or transaction should be relied upon.

Manufacturer warranties may require the customer to work directly with the manufacturer, authorized service provider, distributor, or another designated party.

Texel Comp does not extend or modify a manufacturer warranty unless Texel Comp expressly agrees to do so in writing.

14. Used, Refurbished, and Open-Box Products

Where applicable, product condition will be identified in the product listing, quotation, invoice, or other order documentation.

Customers should review the stated condition before purchasing.

New, refurbished, used, certified-refurbished, and open-box products may have different warranty, packaging, cosmetic, or availability characteristics.

15. Website Availability

Texel Comp does not guarantee uninterrupted or error-free access to the storefront.

The website may occasionally be unavailable due to maintenance, software issues, third-party services, hosting, security measures, or circumstances outside Texel Comp’s reasonable control.

16. Intellectual Property

Texel Comp website content, original written material, graphics, layout, branding, and other proprietary materials may not be copied, republished, distributed, or commercially exploited without permission, except as permitted by law.

Manufacturer names, trademarks, product images, and other third-party intellectual property remain the property of their respective owners.

17. Prohibited Use

Customers may not use the store:

  • for unlawful activity;
  • to provide fraudulent payment or identity information;
  • to interfere with website security or operation;
  • to attempt unauthorized access to systems or accounts;
  • to transmit malicious software; or
  • to violate another party’s intellectual-property or legal rights.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Texel Comp will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of the storefront, products, delayed delivery, loss of business, loss of data, or similar damages.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

19. Force Majeure

Texel Comp is not responsible for delay or failure caused by events outside its reasonable control, including carrier disruption, manufacturer delays, supply-chain shortages, natural disasters, severe weather, government actions, labor disruptions, transportation interruptions, cyber incidents, utility outages, or similar events.

20. Privacy

Personal information handled through the store is governed by Texel Comp’s Privacy Policy and applicable Shopify privacy features.

Customers must not submit patient information, protected health information, medical records, medical images, or other unnecessary sensitive healthcare information through general storefront forms.

21. Changes to These Terms

Texel Comp may update these Terms from time to time.

The version applicable to a transaction is generally the version in effect when the order is placed, unless otherwise required by law or agreed in writing.

22. Governing Law

These Terms are governed by the laws applicable to Texel Comp LLC in the State of Texas, subject to any mandatory consumer-protection or other laws that apply.

Any forum-selection or dispute-resolution provision should be interpreted subject to applicable law.
